includes protecting public employees from unreasonable searches from their government
employer. In Skinner v. Ry. Labor Execs.’ Ass’n, the United States Supreme Court held that drug
testing constitutes a search for purposes of the Fourth Amendment. 489 U.S. 602, 617 (1989).
Accordingly, to be proper under the Fourth Amendment, the drug testing pf a public employee
must be deemed reasonable. American Federation of State, County and Municipal Employees
Council 79 v. Scott, 717 F.3d 851 (11th Cir. 2013) (AFSCME) (citing Chandler v. Miller, 520
U.S. 305, 313 (1997)).
