Since DNA technology entered our criminal justice system in the late 1980s, more than 340 people have been exonerated of wrongful convictions.
That’s good news for the people whose records have been set straight, but it’s actually bad news for the criminal justice system as a whole, according to Daniel Medwed, a Northeastern University professor of law and criminal justice.
What’s so bad about righting those wrongs? First, that the judicial system was wrong that many times about who committed a crime. Second, DNA evidence doesn’t exist in most criminal cases.
“One of the issues of DNA is that it creates the appearance of solving the problem of ‘innocent man convicted,’ but it really doesn’t because so few cases actually involve biological evidence,” Medwed said.
That means there’s less chance of correcting a wrong conviction when there’s no DNA evidence involved, unless we look at why wrongful convictions happen in the first place, said Medwed, who examines the issue in his latest project, the book Wrongful Convictions and the DNA Revolution.

Для нескольких миллионов сидельцев это капля в море, но специалисты говорят, что в реальности все обстоит гораздо хуже, поскольку ДНК доказательства можно использовать только в небольшом количестве случаев - изнасилованиях и убийствах не огнестрельным оружием. В случае грабежа, обороте наркотиков и убийств огнестрельным оружием таких доказательств получить нельзя. Более того, замечу от себя, даже в случаях, когда анализ ДНК возможен, старые дела никто не пересматривает, если только не вмешаются люди со стороны, всякие активисты, поскольку анализ стоит больших денег и открывать заново дело всего лишь для перепроверки данных никто не будет. Во многих случаях сажают только на основании показаний свидетеля, а иной раз и просто за счет признания вины обвиняемым без прочих доказательств. Сами понимаете, свидетели могут плохо помнить, а могут быть заинтересованными лицами, ну а про самооговор я вообще молчу. В качестве иллюстрации приведу вот этот случай:

The former delicatessen worker convicted of killing 6-year-old Etan Patz was sentenced to 25 years to life in prison in Tuesday.
Pedro Hernandez, 56, was sentenced nearly 40 years after the boy’s disappearance, an event that ultimately helped raise national awareness about the plight of abducted children.
A jury convicted Hernandez of murder and kidnapping in February. The sentence was handed down in Manhattan State Supreme Court on Tuesday afternoon. Patz's parents, Julie and Stanley, were in court for the sentencing.
Patz vanished as he walked alone for the first time to a school bus stop in Manhattan’s SoHo neighborhood on May 25, 1979. He would become one of the first missing children to appear on the side of a milk carton seeking information.
For more than three decades, the case endured as one of the country’s most infamous missing child cases until police arrested Hernandez in May 2012 after receiving a tip.
Hernandez, who worked in a bodega near the bus stop, confessed to strangling the boy and then leaving his body in a box outside. He reportedly gave investigators a detailed account of the crime.
His lawyers argued that the admission was the result of police coercion as well as mental illness that made it difficult for Hernandez to separate fantasy from reality. Patz’s body was never found, leaving the confession as the key piece of evidence at trial.
The defense also pointed to another man, Jose Ramos, a convicted pedophile who was long considered a suspect in the crime. Ramos, who is in prison, had a relationship with a woman hired to walk Patz home from school.

Спустя почти 40 лет посадили "убийцу" Этана Патца, который пропал в 1979. Тело не нашли, а приговор вынесли на основании признания одного слабоумного шизофреника, который признал себя убийцей. Никаких иных доказательств не было. Ну а подозреваемый педофил, который в то время был бойфрендом няньки Этана, теперь может спать спокойно. И ничего, что признание было сделано шизофреником. Сойдёт.

Вопрос в том, скольких невинных людей государство казнило и сколько негодяев таким образом избежало наказания.
